President's Message

It was great to see so many people at the meeting last week for Karen Brosi's presentation on Tax Season 2010- What now? She gave us an interesting and informative presentation on what issues our clients will be facing this tax season and during the 2010 year. We truly enjoyed having a past member of the Forum speak to us.

At our last meeting, board member Veronica Dostal prepared cards for you to send to your colleagues, friends, or members who you have not seen in a while to invite them to our March meeting. Please be sure to send the cards. If you are interested in becoming more involved in Financial Planning Forum by joining a committee or the board, please let me know. We are currently in the process of setting our leadership for the 2010-2011 year. The Board of Financial Planning Forum strives to make this organization a benefit to members by providing excellent educational programs and great networking opportunities for our members. Your active participation helps to make us a premier organization in the Bay Area.

Board member Kaye Sharbrough has been busy working to improve our website to make it more user friendly. We should have the improved website up by next month. One of the enhancements is that you will be able to search the member directory by name, category, and keyword to make it easier for our members to access the names of our members. If your member profile is not current, please take the time to update it so that members can easily find you when searching.

THIS MONTH'S PROGRAM

PROPOSITION 13: CHANGE IN OWNERSHIP AND EXCLUSIONS

by Bradley M. Heller, Tax Counsel III at California State Board of Equalization, Tax and Fee Programs Division

On March 23rd we will welcome Bradley Heller who will speak on "Proposition 13: Change in Ownership and Exclusions." He will provide background information on the State Board of Equalization and its property tax functions, discuss the fundamentals of propositions 8 (decline in value) and 13 (change in ownership), explain how the change in ownership rules apply to trusts, and explain how the change in ownership rules apply to transfers into and out of legal entities and transfers of interests in legal entities.

Mr. Heller has worked at the California State Board of Equalization in Sacramento since 2000. He is currently Tax Counsel III (Specialist) in the Tax and Fee Programs Division. Since 2004, Mr. Heller has been the lead attorney responsible for promulgating the Board of Equalization Rules for Tax Appeals. He currently advises the public, staff, and the Board regarding sales and use taxes, special taxes, franchise and income taxes, property taxes, fees and administrative procedures.

Prior to his current position, Mr. Heller was the primary attorney responsible for advising staff on issues involving the taxation of estates, trusts, and real estate investment trusts for the Franchise Tax Board. He served as a protest hearing officer and represented the Franchise Tax Board (FTB) in appeals to the State Board of Equalization involving the taxation of estates, trusts, individuals, partnerships, and corporations. He also served on the technical advisory team implementing California's qualified small business stock provisions and co-edited the FTB's S corporation audit manual. Mr. Heller received his LLM in Taxation from University of San Diego School of Law and his JD from Whittier Law School. He graduated from Cal State University in Long Beach.

He regularly speaks at the California Tax Policy Conference (2005, 2006, 2008, and 2009)
